D.L. 36/2025: The Class Action to ask the Italian State to recognize the citizenship rights of the descendants of Italian immigrants who have been on the waiting list at the consulate for years

With the d.l. 36/2025 the Italian Government has decided, out of the blue, to close the doors in the face of millions of descendants of children of Italians who have been waiting for years for an appointment at the consulate to obtain an Italian passport. Although it is well known to the judiciary and Parliament that the waiting lists of over ten years present in all the major Italian Consulates abroad such as San Paolo in Brazil, Buenos Aires in Argentina, Chicago, New York, Boston, Philadelphia in the United States, were due exclusively to the Administrative inability of the Consulates and the Italian State to manage their offices, the Government has in fact denied the right to citizenship by descent.

It is now up to us lawyers and legal experts to keep faith with the oath we have taken and mobilize to defend the rights of our fellow citizens in compliance with and in application of Italian laws.

Waiting lists to obtain recognition of Italian citizenship by descent iure sanguinis are illegal!

It is unlawful to deny the right to citizenship according to the law within a reasonable time, to those who are descendants of an Italian citizen who emigrated.

It is unconstitutional to definitively remove the right to request citizenship by descent from an Italian ancestor, to those who have waited for years, silently suffering the abuse of power of the Public Administration.

The Italian State is responsible towards the millions of people of Italian origin who have legitimately relied on the Consulates to see their right to citizenship iure sanguinis recognized despite having to wait decades!
